These Terms of Service ("Terms") govern your access to and use of the jim.coach mobile application and website (collectively, the "Service"). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are accessing or using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
2. Changes to Terms
We may modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms and, in some cases, provide additional notice (such as adding a statement to our website or providing in-app notification). Your continued use of the Service after the changes have been made will constitute your acceptance of the changes.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
You agree not to share your account credentials with others or allow others to use your account. You must notify us immediately if you suspect any unauthorized use of your account or access to your password.
4. Subscription and Billing
Some features of the Service require a subscription. When you subscribe, you agree to pay the subscription fees indicated. Subscription fees are billed in advance and are non-refundable. You can cancel your subscription at any time, and your subscription will continue until the end of your current billing period.
We may change subscription fees at any time, but changes will not apply to your current subscription period. If we change the fees for your subscription, we will provide notice of the change and the opportunity to cancel before the change takes effect.
5. Free Trial
We may offer a free trial of our subscription service. The duration of the free trial period will be specified during sign-up. We reserve the right to modify or terminate free trials at any time without prior notice. We may limit eligibility for free trials to prevent abuse, and we may automatically charge you at the end of the free trial period unless you cancel before that date.
6. User Content
Our Service may allow you to store or share content such as text, images, or other materials ("User Content"). You retain all rights in your User Content, and you are responsible for your User Content.
By providing User Content to the Service, you grant us a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Service.
You agree not to post User Content that violates these Terms, the rights of others, or applicable laws.
7. Health Disclaimer
The Service provides general fitness guidance and is not intended to replace professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before beginning any exercise program, especially if you have any medical conditions or concerns.
You acknowledge that there are risks associated with any physical activity and that you are voluntarily participating in these activities with knowledge of the dangers involved. You agree to assume all risks of injury or harm that may result from using our Service.
8. Limitation of Liability
To the maximum extent permitted by law, in no event will jim.coach, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Termination
We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
10. Governing Law
These Terms shall be governed by the laws of the State of California, without respect to its conflict of laws principles. Any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the state and federal courts in San Francisco County, California.
